GENERAL INFORMATIONS

These general conditions govern the sale of marketed products owned by:

The company reserves the right to modify these conditions of sale at any time by reporting them on the site. Any liability for direct and / or indirect damage to persons and / or things caused by the non-acceptance, even partial, of an order is excluded. All published prices are inclusive of VAT.

 

PURCHASE METHOD

 

The purchase is made by accessing the website www.ep1963.com. Only products available at the time of consultation can be purchased unless otherwise indicated in the product information. Ep1963.com reserves the right to modify the characteristics of the single product, also to adapt it to the manufacturer's specifications, without the need for prior notice; therefore the proposed images and the descriptive card may not be perfectly representative of the product and differ in color, size and accessories.
Once the product is displayed, it will be possible to add it to the cart and, in the following windows, confirm the purchase after verifying and confirming the characteristics, price, methods and shipping costs. Ep1963.com, once verified the real availability of the ordered product, issues order acceptance through a self-generated e-mail summarizing the characteristics, price and general and particular conditions of sale applied to the product. Such communications will also contain an "order number"
In case of non-acceptance of the order by ep1963.com, the company undertakes to promptly notify the Customer.
All prices on the site are VAT INCLUDED. The company reserves the right to modify them at any time, without prior notice or notification. In the event that the sale price is incorrect and / or clearly unreal due to an error, the order will be canceled even if confirmed and the Customer refunded the amount paid.
Sales will be accompanied by a tax invoice.

TERMS OF PAYMENT

 

1. Advance Bank Transfer
in case of payment by bank transfer, the order will be processed and shipped only from the working day following the crediting of the amount on the c / c reported. Payment must be made within 5 working days under penalty of cancellation of the order. The bank details are shown on the confirmation email. The "order number" indicated in the confirmation e-mail must be indicated in the reason for the transfer.

2. Credit Card
In cases of purchase of goods with a credit card payment method, at the same time as the online transaction is concluded, the reference bank authorizes only the commitment of the amount relating to the purchase made. The amount relating to the fulfilled goods is charged to the Customer's credit card at the time of the actual fulfillment of the order. The credit cards accepted are all those that rely on the Visa, Mastercard and American Express, Diners and Jcb circuits. Ep1963.com reserves the right to request additional information from the customer (eg landline phone number) or to send copies of documents proving ownership of the card used. In the absence of the required documentation, the order will be canceled. At no time during the purchase procedure is ep1963.com able to know the information relating to the buyer's credit card, as they are typed directly on the website of the bank that manages the transaction. Since there is no data transmission, there is no possibility that this data will be intercepted. No computer archive of ep1963.com contains or retains such data. In no case ep1963.com can therefore be held responsible for any fraudulent and improper use of credit cards by third parties, upon payment for products purchased on ep1963.com.

 

3. PayPal
In case of purchase through the PayPal payment method, at the end of the order the Customer is directed to the PayPal login page. The amount relating to the order is charged to the PayPal account at the time the order is acquired. In case of cancellation of the order, both by the Customer and in case of rejection of ep1963.com, the amount will be refunded to the Customer's PayPal account. At no time during the purchase procedure ep1963.com is able to know the Customer's financial information. Since there is no data transmission, there is no possibility that this data will be intercepted. No computer archive of ep1963.com contains or retains such data. For each transaction made with the PayPal account, the Customer will receive a confirmation e-mail from PayPal.

CONCLUSION OF THE CONTRACT

 

The amount of the purchases will be calculated on the sum of the cost of all the items to be purchased, including VAT, net of shipping costs or any other additional costs communicated in the order.
By selecting the button "I confirm my order" during the purchase process, the buyer declares to accept fully and without reservations all of these General Conditions of sale.
Ep1963.com will confirm their orders by sending an email.
Ep1963.com reserves the right to change its prices at any time, but the products will be invoiced on the basis of the rates in effect at the time the orders are stored.
The products remain the property of the supplier until the total settlement of the amount due.

 

SECURITY OF TRANSACTIONS

 

The Virtual POS manages, with the acquirers enabled, transactions with the 3D Secure protocols (3 - Domain Secure) Verified by Visa, MasterCard Secure-Code and SafetyKey American Express, which ensure greater protection on internet purchases as, to conclude the payment, require authentication of the credit card holder.

 

DELIVERY METHODS

 

Ep1963.com can only accept orders for delivery in the territory of the Italian state.
Ep1963.com does not ship to Mail Boxes, post offices, post office boxes and to companies that provide domiciliation services.
Delivery takes place by express courier BARTOLINI at the shipping cost indicated on the screen during the completion of the order.
The cost of shipping is borne by the buyer, according to the rates and costs indicated. Each delivery is considered completed from the moment in which the transporter makes the products available to the buyer, as resulting from the system used by the transporter to track shipments. It is the recipient's responsibility to check the products upon delivery and possibly raise any reservations and complaints that appear justified, including the possibility of rejecting the package if it has been opened or shows evident signs of deterioration.

No responsibility can be attributed to ep1963.com in case of delay in the order or delivery of the ordered goods.

 

Upon delivery of the goods by the courier, the Customer is required to check:
- that the number of packages delivered corresponds to what is indicated on the delivery note or transport document (DDT);
- that the packaging is intact, not damaged or wet or, in any case, altered. Any external damage or mismatch
the number of packages must be immediately reported to the courier making the delivery, adding the words "collection with reserve for damaged package", or "collection with reserve for open package" or "collection with reserve for missing packages" on the appropriate accompanying document .

SHIPPING FEES

 

FREE SHIPPING FOR ORDERS OVER € 50.00 (VAT included, excluding shipping costs).
For orders from € 0 to € 50.00 the cost of shipping is € 6.70 (VAT included) with the exception of the islands and Calabria where the cost is € 9.80 (VAT included).

 

RIGHT OF WITHDRAWAL

 

In compliance with the provisions of the Consumer Code, the Customer has the right to withdraw from the purchase contract, without giving any reasons except in the following cases of exclusion:

  • Goods made to measure or clearly personalized

  • Short-term or rapidly deteriorating assets

  • Goods delivered sealed and non-returnable for hygienic reasons

 

The maximum term within which the intention to make use of this right is to be received is 14 days from the day of receipt of the goods by the recipient or by a third party designated by the latter. The methods for making use of this right will be expressed in the following paragraphs.
The shipment of the returned goods or the return of the goods at one of our stores must take place within 14 days following the communication of withdrawal by the Customer (after which the right will be considered forfeited) to the following address attaching a copy of the order : EP Spa via Del Commercio 1 25039 Travagliato BRESCIA.
The burden and responsibility of returning the return shipment is intended to be borne by the Customer until it is received by EP Spa.
It will be the responsibility of the seller to report the receipt of goods damaged during transport to the customer who can claim this damage against the courier. Ep1963.com, in this case, will make the goods available to the Customer by canceling the withdrawal procedure.
Once ep1963.com has received the goods, it will reimburse the Customer for the amount paid except for additional expenses beyond those provided for by the basic shipping rate, to which ep1963.com is not required to respond in the event of withdrawal.
The right of withdrawal lapses in case of substantial defect of the returned product (original packaging not intact or missing, damage, unsuitable state of return, evident signs of wear and / or neglect) and in the cases previously set out.
In case of forfeiture of the right of withdrawal ep1963.com will return the goods to the customer who will not be entitled to any refund.
To exercise the right of withdrawal, the Customer is required to notify ep1963.com preferably through the website using the "return product" function. Follow the instructions, download and fill in the RETURN FORM.

WAIVER OF PURCHASE

 

We inform you that the Customer has the right to reject the goods upon delivery. However, it should be noted that, upon issuing the refund credit note, in the event of advance payment (credit card, Paypal, advance bank transfer), the shipping costs will be reversed up to the delivery address and return to the sender. Therefore, only the amount of the product will be refunded, net of round-trip transport costs.

Object and purpose of the processing of personal data
The following personal data will be processed: name, surname, address, telephone number, e-mail, tax code.

JURISDICTION AND APPLICABLE LAW

The sales contract between the customer and ep1963.com is concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes deriving from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference forum of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Brescia.
